Building a Consent-Free Cabin

The good news is that in most cases, you can build all our timber cabins from 5m2 to 29m2 without a building consent in New Zealand, provided certain conditions are met. Adding a SheShed as a sleepout, garden shed, studio, or backyard home office is becoming increasingly popular across New Zealand. Many homeowners want extra space for work, hobbies, or relaxation without the time, cost, and complexity of the full building consent process required for a home extension.

Under exemptions within the Building Act 2004, homeowners can generally build a detached structure, up to 30 square metres in size, without needing building consent, if the building remains simple in design, and does not include plumbing or kitchen facilities.

Our SheShed cabins ranging from 5m² to 29m² are especially popular because they comfortably fit within these consent exemption rules as a "single-storey detached building" - they are ideal for creating extra space in your backyard without creating too many obstacles!

The Key Requirements for Building a Cabin Without Consent

Because SheShed kitsets are structurally certified by a New Zealand engineer, they can qualify for an exemption from New Zealand building consent requirements, provided they also:

  • Are 30m² or smaller.
  • Are detached from the main house. (and minimum 1-metre away)
  • Are single storey, with floor level not more than 1-metre above ground level. (No mezzanine floors allowed)
  • Have no plumbing or sanitary fittings (no sinks, toilets, or showers).
  • Have no kitchen or cooking facilities.
  • Are assembled according to kitset instructions.
  • Comply with the New Zealand Building Code.
  • Comply with the District Plan. (Each council creates its own District Plan specific to its area, so rules may vary depending on where your project is located.)

Even if building consent isn’t required based on the above conditions, it’s still a good idea to keep local planning rules in mind, like boundary setbacks, height limits, and site coverage, as these guidelines are usually part of the District Plan which is set by your local council and can vary depending on your property location.
